When a Muslim dies in Virginia

You do not have to do this alone, or all at once. Your masjid has done this many times. Follow the steps in order, and open each one when you reach it.

What Virginia law says
Death certificate filing
The funeral director (or next of kin) who first takes custody of the body completes the death certificate and files it electronically through the state's Electronic Death Registration System within three days after the death, before burial or removal from Virginia. Ask the funeral home to confirm when it has been filed. Va. Code § 32.1-263
Ordering death certificates
Certified copies of a Virginia death certificate come from the Virginia Department of Health, Office of Vital Records, online, by mail, or at local health department and DMV offices. Full copies go to immediate family (parents, current spouse, children, siblings and grandparents); others with a legitimate need can get a Verification of Death. Embalming and refrigeration
A Virginia funeral home needs express permission from the next of kin, in writing (or verbal permission confirmed in writing), before embalming. If the funeral home or crematory will hold the body more than 48 hours before burial, cremation or embalming, it must keep the body refrigerated. 18VAC65-20-510 (express permission to embalm) and 18VAC65-20-581 (refrigeration)
Objecting to an autopsy
We found no Virginia statute that lets a family refuse an autopsy on religious grounds. The Office of the Chief Medical Examiner decides whether one is needed when a death is sudden, unattended or suspicious, so tell that office about your religious objection as early as possible. Va. Small estates
In Virginia, if the person's entire personal probate estate is worth $75,000 or less, a person entitled to it can collect property with a small estate affidavit once at least 60 days have passed since the death. Ask the circuit court clerk if you are unsure whether the estate qualifies. Va. Code § 64.2-601
