When a Muslim dies in Montana

You do not have to do this alone, or all at once. Your masjid has done this many times. Follow the steps in order, and open each one when you reach it.

As soon as you can, call your masjid’s funeral committee.They will arrange the washing, the shroud, the prayer and the burial, and tell you which funeral home to use.

Death certificate filing
The person in charge of disposition (usually the funeral director) gets the cause of death certified by the doctor, nurse practitioner or coroner and files the certificate with the local registrar within the time the health department sets by rule. Ask the funeral home to confirm it has been filed. MCA 50-15-403
Ordering death certificates
Certified death certificates come from the Montana Office of Vital Statistics, Department of Public Health and Human Services in Helena; requests need a clear copy of both sides of a government photo ID. The funeral home can usually order copies for you. Where to Write for Vital Records: Montana
Objecting to an autopsy
Montana law has no religious-objection provision for autopsies and says the family's consent is not required when the coroner, county attorney or attorney general orders a postmortem examination. If you object for religious reasons, tell the coroner immediately and ask in writing. MCA 46-4-103
Small estates
If the probate estate, after liens, is $100,000 or less, a successor can collect personal property with an affidavit 30 days after the death if no personal representative has been appointed. Ask the clerk of the district court in the county where the person lived about the form. MCA 72-3-1101

    Many funeral homes work with Muslim committees. Your committee will usually name one.

  6. Wash and shroud the body

    Done by trained Muslims of the same sex, or by the spouse. The committee usually provides the cloth.

    Mourning is kept to three days, except by a widow, who mourns four months and ten days, the length of her ʿiddah, or until she gives birth if she is pregnant.
