When a Muslim dies in Massachusetts
You do not have to do this alone, or all at once. Your masjid has done this many times. Follow the steps in order, and open each one when you reach it.
As soon as you can, call your masjid’s funeral committee.They will arrange the washing, the shroud, the prayer and the burial, and tell you which funeral home to use.

- Death certificate filing
- The doctor or medical examiner must furnish the medical certificate of death immediately, and the funeral director must get a burial permit from the board of health or town clerk before burying or otherwise disposing of the body. The statutes we read set no number of days, so ask the funeral home to confirm the certificate and permit are done. M.G.L. c. 46, 9; c. 114, 45
- Ordering death certificates
- Death certificates are issued by the Massachusetts Registry of Vital Records and Statistics, part of the Department of Public Health. The funeral home can usually order copies for you, so ask how many you will need. Where to Write for Vital Records: Massachusetts
- Embalming and refrigeration
- Massachusetts does not require embalming, according to the Funeral Consumers Alliance of Western Massachusetts. A body may not be cremated within 48 hours of death unless the person died of a contagious or infectious disease, so plan for that wait. M.G.L. c. 114, 44; FCA of Western Massachusetts
- Objecting to an autopsy
- We found no Massachusetts statute that lets a family refuse a medical examiner's autopsy on religious grounds; the medical examiner decides under chapter 38. If you object for religious reasons, tell the medical examiner's office as early as possible. M.G.L. c. 38, 6
- Small estates
- If the estate is personal property worth $25,000 or less, an interested person can ask the Probate and Family Court for voluntary administration 30 days after the death, a simpler process than full probate. Ask the Registry of Probate in the county where the person lived for the forms. M.G.L. c. 190B, 3-1201
