When a Muslim dies in California
You do not have to do this alone, or all at once. Your masjid has done this many times. Follow the steps in order, and open each one when you reach it.
As soon as you can, call your masjid’s funeral committee.They will arrange the washing, the shroud, the prayer and the burial, and tell you which funeral home to use.

- Death certificate filing
- The funeral director prepares the death certificate and registers it with the local registrar. It must be registered within eight calendar days after the death and before burial. Cal. Health & Safety Code §§ 102775, 102780
- Ordering death certificates
- Certified death certificates are available from the California Department of Public Health, Vital Records. The sworn statement on the application must be notarized for a certified copy. Where to Write for Vital Records: California
- Embalming and refrigeration
- California law does not require embalming. If the body is not embalmed and the funeral home holds it for more than 24 hours, it must be refrigerated. Consumer Guide to Funeral & Cemetery Purchases; Cal. Code Regs., tit. 16, § 1223(c)
- Objecting to an autopsy
- An adult can sign a certificate of religious belief, in front of two witnesses, stating that an autopsy would violate their religion, and the coroner generally must honor it; if family tells the coroner such a certificate exists, the coroner must wait 48 hours for it to be produced. The coroner can still order an autopsy if a crime or a contagious disease is suspected, or ask a court to allow one. Cal. Government Code § 27491.43
- Small estates
- For deaths on or after April 1, 2025, an estate worth $208,850 or less can usually be collected with a small estate affidavit instead of full probate, once 40 days have passed. This limit is adjusted every three years (next on April 1, 2028), and some court self-help pages still show the older $184,500 figure, so ask the probate court if unsure. Cal.
